Commissions Terms of Service

All commissioned artwork is bespoke. The following terms and conditions apply to the commissions service provided by the artist, Lewis Washington to you, the client.

Please read these terms and conditions carefully. Commissioning artwork or services from Lewis Washington (the Artist) implies you have read, understood, and accepted these terms and conditions. 

Acceptance:

It is not necessary for the Client to have signed an acceptance of these terms and conditions for them to apply. If the Client commissions artwork from Lewis Washington (the artist) the client will be deemed to have satisfied themselves as to the terms and have accepted these terms and conditions in full.

Price Quotation and Acceptance:

Charges for commissions and services provided by Lewis Washington (the artist) are defined in the price quotation that the Client will receive via Email. A valid Email must be provided by the client. Quotations are valid for a period of 30 days. Lewis Washington (the artist) reserves the right to amend or refuse to honour a quotation after the expiry of 30 days. The client must accept the quotation via Email before the commencement of the commission or service.

Services:

Prior to a quotation, Lewis Washington (the artist) will discuss the size, price, and estimated completion date of the commission or sketch. A copy of an initial sketch will be sent via Email to the client, at which point amendments to the commission content can be discussed and agreed. The client will then receive a quotation via Email.

Lewis Washington (the artist) reserves the right to share work-in-progress images of the commission to social media and/or website unless agreed otherwise with the client. For example, this may be due to a surprise or gifted commission.

Once the Commissioned artwork is complete, a watermarked digital copy will be Emailed by Lewis Washington to the Client. At this point, only minor amendments can be discussed.

A delay in the completion of the commission by the artist caused by a Force Majeure Event shall not be deemed a breach of the agreement or estimated timescale quoted.  

Copyright:

Lewis Washington (the artist) retains full copyright of the artwork commissioned by the client.

Upon full payment, the client will retain ownership of the physical artwork but must obtain permission from the artist to share the artwork on social media or any website. Lewis Washington (the artist) retains full copyright of the artwork. If this client wishes to reproduce the artwork in any format, this must be prior agreed with Lewis Washington (the artist).

Lewis Washington (the artist) reserves the right to display the artwork on/in their social media, website, studio, brochures, web and print advertisements. If the client is unhappy with the artwork being displayed, this must be declared upon placing the commission. This may result in a higher quotation price.

Payment:

Lewis Washington (the artist) will require a non-refundable deposit of 30% of the agreed total cost. The payment of this will signify the commencement of the commission. 

Once the artwork is completed, an invoice for the remaining cost will be invoiced to the Client via Email. Payment is due within 7 working days of the invoice via Bank Transfer (BACS). Please Email lewiswashingtonsketch@gmail.com for accepted alternative payment methods. Cash payment is only accepted if agreed by the Artist prior to quotation (namely for local clients).

Refund Policy:

All commissioned artwork is non-refundable as it is bespoke to the client and cannot be easily resold. The full agreed price must be paid on completion of the artwork, minus any deposits already paid. The artist reserves the right to retain all non-refundable deposits.
